Please read these Terms and Conditions carefully before using any Post Heritage service. By engaging Post Heritage Inc. for any service or using this website, you agree to be bound by these terms.

1. About Post Heritage Inc.

Post Heritage Inc. is a creative supply chain company incorporated as an S-Corporation and established in 2017. We provide print solutions, creative services, brand management, product sourcing, and digital marketing services to small businesses. Our principal place of business is in New York.

2. Acceptance of Terms

By accessing this website, submitting an inquiry, signing a service agreement, or engaging Post Heritage Inc. for any service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

These Terms apply to all clients, visitors, and individuals who interact with Post Heritage Inc. in any capacity.

3. Services

Post Heritage Inc. provides services across five pillars:

  • Print Solutions - In-house and outsourced commercial printing including business cards, flyers, menus, banners, NCR forms, direct mail, and specialty stocks.

  • Creative Services - Logo design, graphic design, copywriting, production-ready artwork, and event materials.

  • Brand Management - Brand guidelines, asset libraries, identity systems, and ongoing brand consistency management.

  • Product Sourcing - Branded merchandise and promotional products sourced through domestic and Asia-Pacific supply networks.

  • Digital Marketing - Google Business Profile management, social media management, paid advertising, SEO, and email marketing delivered across three service tiers.

The specific scope of services for each engagement is defined in the individual service agreement signed between Post Heritage Inc. and the client. In the event of any conflict between these Terms and a signed service agreement, the service agreement shall take precedence.

4. Agreements, Fees, and Payment

All services require a signed service agreement before work begins. Verbal agreements, email confirmations, and informal approvals do not constitute a binding engagement.

Project-based services are quoted per project. Quoted prices are valid for 30 days from the date of issue unless otherwise stated.

Monthly retainer services (Digital Marketing tiers) are billed on a recurring monthly basis. The monthly fee is due on the same date each month as established in the service agreement.

Payment terms are net 15 unless otherwise specified in the service agreement. Post Heritage Inc. reserves the right to pause or suspend active work on any account with an outstanding balance past 15 days from the due date.

Late payments may be subject to a late fee of 1.5% per month on any outstanding balance.

Accepted payment methods are specified in each service agreement. Post Heritage Inc. does not store payment card information directly.

5. Onboarding Fee Policy

Work does not begin until both the signed service agreement and the onboarding fee payment have been received in full. This applies to all Digital Marketing tier engagements without exception.

The onboarding fee is a one-time, non-refundable fee charged at the start of every Digital Marketing engagement. The fee covers the full discovery audit, 90-day strategy, account setup, brand intake, and first-month content calendar - all work completed before the first monthly retainer payment is due.

Onboarding fees by tier:

  • Starter Tier: $750 one-time

  • Essentials Tier: $1,200 one-time

  • Growth Tier: $2,000 one-time

The onboarding fee is non-negotiable, non-waivable, and non-deferrable. No exceptions will be made regardless of the circumstances of the engagement.

6. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information required to deliver the agreed services. This includes but is not limited to:

  • Brand assets (logos, color codes, fonts, brand guidelines) in usable file formats

  • Business information (name, address, phone, hours, website) exactly as it should appear in public-facing materials

  • Account access (Google, Meta, website CMS) as required by the service tier

  • Timely feedback and approvals on proofs, content calendars, and strategy documents within the timeframes specified in the service agreement

  • Accurate and lawful content - clients are solely responsible for ensuring that all information, images, and materials provided to Post Heritage Inc. do not infringe on any third-party rights

Delays caused by a client's failure to provide required materials or approvals on time may result in adjusted timelines. Post Heritage Inc. is not liable for delays attributable to the client.

7. Intellectual Property

Client-owned materials: All intellectual property provided by the client (logos, copy, images, brand assets) remains the sole property of the client. Post Heritage Inc. uses these materials solely for the purpose of delivering the agreed services.

Work product: Upon receipt of full payment for a project, Post Heritage Inc. assigns to the client all rights to the final deliverables produced specifically for that engagement. This transfer applies to final approved files only - not to preliminary concepts, drafts, or unused design directions.

Post Heritage proprietary materials: All methodologies, templates, systems, workflows, and tools developed by Post Heritage Inc. remain the intellectual property of Post Heritage Inc. and are not transferred to the client as part of any engagement.

Portfolio rights: Post Heritage Inc. reserves the right to display completed work in its portfolio, on its website, and in marketing materials unless the client requests in writing that a specific project remain confidential.

8. Approvals and Proofs

Post Heritage Inc. provides proofs and approvals at defined stages of each project. The client is responsible for reviewing all proofs carefully before approving them for production.

Print production: Once a client approves a proof in writing (email or digital signature), Post Heritage Inc. proceeds to production. Post Heritage Inc. is not responsible for errors - including spelling, color, sizing, or layout - that are present in an approved proof and reproduced in the final printed material.

Product sourcing: A physical sample must be approved by the client before any production order is placed. Production does not begin without written sample approval. Post Heritage Inc. is not responsible for variations between a sample and a production run that fall within standard manufacturing tolerances.

Digital content: Monthly content calendars require client approval before any content is published. By approving a calendar, the client confirms that the planned content is accurate and authorized for publication.

9. Cancellation and Termination

Project-based services: Cancellation of a project after work has commenced may result in a cancellation fee equal to the value of work completed to the date of cancellation. Completed deliverables remain billable in full.

Monthly retainer services: Either party may terminate a Digital Marketing retainer engagement with 30 days written notice. Written notice must be delivered by email to info@postheritage.com. The final invoice covers the 30-day notice period in full.

Immediate termination: Post Heritage Inc. reserves the right to terminate any engagement immediately and without notice in the event of non-payment past 30 days, client misconduct, or any request that requires Post Heritage Inc. to produce content that is unlawful, defamatory, or in violation of these Terms.

Refunds: Onboarding fees are non-refundable under all circumstances. Retainer fees paid for a current billing period are non-refundable once work for that period has commenced.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Post Heritage Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to the use of our services, including but not limited to loss of revenue, loss of profits, loss of business, or loss of data.

Post Heritage Inc.'s total liability for any claim arising from or related to a specific engagement shall not exceed the total fees paid by the client to Post Heritage Inc. for that engagement in the 12 months preceding the claim.

Post Heritage Inc. is not responsible for outcomes attributable to third-party platforms (including Google, Meta, TikTok, or any other advertising or social media platform), third-party service providers, or factors outside of our direct control.

11. Warranties and Disclaimers

Post Heritage Inc. warrants that services will be performed with reasonable care and skill in accordance with industry standards.

Post Heritage Inc. does not warrant or guarantee specific business outcomes, sales results, search rankings, social media growth metrics, or advertising performance. Digital marketing results depend on numerous variables outside of our control, including platform algorithm changes, market conditions, and client business factors.

This website and all content on it are provided "as is" without warranty of any kind, express or implied.

12. Third-Party Services and Ad Spend

Some Post Heritage services involve or recommend third-party platforms and tools including Google, Meta, TikTok, Mailchimp, and others. Post Heritage Inc. is not affiliated with, endorsed by, or responsible for any third-party platform.

Ad spend: Advertising budgets paid to third-party platforms (Meta, Google, TikTok, or others) are always separate from Post Heritage Inc. management fees. Clients pay advertising platforms directly. Post Heritage Inc. does not mark up ad spend under any circumstances. Post Heritage Inc. is not responsible for ad spend charged by third-party platforms, including charges resulting from platform errors or policy changes.

Third-party platform terms, policies, and pricing are subject to change at any time and are outside of Post Heritage Inc.'s control.

13. Confidentiality

Post Heritage Inc. treats all client business information, including brand assets, financial details, business strategies, and client lists, as confidential. We do not share client information with third parties except as required to deliver the agreed services (for example, sharing files with a printing partner or platform).

Clients agree to treat Post Heritage Inc.'s proprietary methodologies, pricing structures, and internal processes as confidential and not to disclose them to third parties without prior written consent.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising from these Terms or any Post Heritage Inc. service engagement shall be resolved in the courts of the State of New York.

15. Changes to These Terms

Post Heritage Inc. reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services following any changes constitutes acceptance of the revised Terms.

For material changes affecting active service agreements, Post Heritage Inc. will provide at least 30 days’ written notice by email.
